I have been looking for a lawyer in Texas that could advise me in regards to Gaming Laws. I have searched, but have not been given a good recommendation. Anyone on this forum able to recommend one?

We have looked into this. The math doesn't hold water in this town unless it is used for other things during the week for the most part.

I have a buddy that tried to do this here. Plans came to a halt after he met with the DA to discuss. DA said everything would be done to prevent it from opening....

Yup. Definitely get your permits in a row first. And don't thumb your nose at the city and hold a press conference to complain when you try to break the ordinances and the city starts writing citations.

I personally met with DA with my attorney aside to show him my legit business plan and he clearly said he would prosecute and close me down.

If you read about the big storey in Houston, I think they are taking home about $300K a month, but it is a matter of time before the AG busts that operation into 10,000 foot crater.

What would the local DA charge the establishment with to close it down? I don't even play much poker but I had looked into some of the laws years ago because I was curious. House poker parties happen all the time and are legal as long as they follow the laws talked about in the article posted above. What is the big deal if someone wants to setup a place to rent out rooms for people to play poker. Are there laws specific to this area that I'm not aware of?

I think the point is that when the DA says he will do everything in his power to shut it down to the point of prosecution and/or involving the TABC, it would be unwise to proceed.

Absolutely understood, but what if TABC isn't involved? Then I think you could fight it as a personal vendetta. I get that the DA has a ton of pull, but that kind of wielding of power seems unprofessional.

Again, I'm not saying it's time to bring poker rooms into BCS, but I also think it's possible that this isn't a gateway to other businesses. I've said it on other threads: this ain't the cowtown you lived in during your college days. Either embrace the cultural shift or don't. You don't get both.

And that's the catch. The ability to run a non alcoholic poker room may end up as lore. Haha. Then, however, you end up in a direct battle with the DA. I just don't understand the guaranteed battle.

According to the article, the Houston establishments avoid the TABC by not serving alcohol.

I wonder if our existing board and card game place on Harvey (I think it's called Clockworks) could add poker to their list. This doesn't seem much different from what they already do. Different audience, but same idea.

The Houston clubs have a rake just in a different form that a typical rake in card rooms across the country.

Texas law will hard for a business to make money at this without a gray area being involved.
The DA sounds like he would push the grey area towards a shut down.

And the math doesn't work unless it is used on weekends only to the size to make real money

What makes you think the DA isn't just bluffing.
He would have to make the prosecution stand up in court; it takes more than just his opinion.

What crime did he tell you he would be pursuing to shut you down? Doesn't seem like this would be a felony offense, but I could be wrong. Which DA did you meet with, the current one? Mr. Parsons has never come off in that sense and I've known him for several years now.

Exactly. It's a tough stretch that anything gambling or alcohol related would fall under the jurisdiction of the DA here. All of the gambling and most alcohol offenses fall under the County Attorney because they're misdemeanors. Really, the only alcohol offenses that are felonies are DWI that are enhanced due to injuries/death/repeat offenders.

Not to mention, if the establishment was made byob and just do setups for mixed drinks then TABC would have a minimal hand in it anyways. If the sock could keep a liquor license I don't see how a gaming room wouldn't be able to maintain a beer and wine permit...
