That is stupid. They ought to just leave if they have no intention of following any ordinances.

After all the violations and citations, it'd be nice if the city could either arrest the owner or start collecting some fines and/or impounding some merchandise.

I think rules should be followed (even dumb ones until they're changed). But frankly, I don't give a rat's a$$ whether planet k is located in Bryan at all, at their current location in Bryan, or elsewhere in Bryan - I won't be shopping there. I would, however, hate to see a lot of tax dollars spent on this case.

Re the KBTX thread, I understand other business owners being a tad upset because they had to "play by the rules" while PK appears to not want to.

What I don't understand are the criticisms based purely on aesthetics; its not like that stretch of Texas Ave in Bryan was Bedford Falls, and the arrival of Planet k suddenly transformed it into Pottersville.

The Eagle's article makes it seem the Bee Cave was apples to oranges. Evidently they put up a Bernie sign outside of political season. Under the Highway Beautification Act that was a no-no. They sued under free speech and won on appeal.

This is a lawsuit against the city for their sign ordinance. I think it will be a different battle altogether.

I believe the case cited in the eagle might be part of a different suit after planet k was already open. I am referring to the 2011 case filed to keep planet k from opening, which was settled in 2012 according to this article from the statesman: https://www.statesman.com/NEWS/20120921/Bee-Cave-and-Planet-K-owner-settle-dispute

The plot thickens. Doesn't look as open and shut from this angle, imo.

Well, on the surface at least, it doesn't look like the city gave up too much. That makes me smile.

*Planet K will not be allowed to sell sexual oriented/adult novelty items...


*The current outdoor sign must be removed within 7 days. Planet K has agreed to replace it with a sign that meets city code.

*Improvements to the parking lot and landscaping will be completed so as to bring the property into compliance with city code.

I guess the whole free speech thing just went away(?). I'm glad they didn't change the height/size limitations; that would have started an avalanche (and rightfully so) of sign appeals all along Texas Av.

According to things I've heard and read, Planet K can't sell adult novelty items, has to change their sign and improve their parking lot, doesn't have to pay 34 citations, and both sides pay their own attorney's fees. If this is all true, then I would call this a wash with both sides getting some but not all of what they want.

Some zoning regulations and building codes are awesome, particularly those that are there for public and personal safety reasons. Some are either too restrictive or are just an attempt to impose a small group's values (council/other organizations) on society as a whole - I'm less supportive of that.

In this case, I don't think the size, placement of the current sign is problem, I think that parking lots should be correctly constructed and accessible, and it doesn't matter to me whether they sell adult novelty items or not. Further, and as I've said before, I never plan on going to Planet K for any reason, a choice we can all make or not.

Too many people think that there's no middle ground. Either you're a 1) socialist commie who wants nothing more than to grow government until it controls everything and that everything down to font choice on a sign should be regulated by the state and that any disagreement with such is tantamount to treason or 2) a heartless libertard/conservatard and that the only government regulation worthwhile is the one where the government shrinks itself small enough to drown itself and providing funding for the water.

To me, sign is fine, fix the parking lot to basic accessible standards, sell whatever you want that's legal for sale inside (I'd be fine with a no advertising of adult items outside addendum).

Agree, and considering there are multiple head shops, vape shops, tattoo parlors, pawn shops and adult novelty stores within 1.5 blocks on the same exact street, I don't think they're acting in good faith.
