I'd rather have the good side. Makes it easier to weedeat since you don't have to work around the posts.

As for jumping the fence, meh...with or without the cross boards I can get my 260 pound butt over a 6 foot privacy fence pretty easy with the right motivation.

Yeah, most likely no, but it is best to properly frame the debate over position of the fence, or the builder...

As a followup, owner is responsible for the wind damage to the fence. He is getting a contractor to look at it and submit a bid, and asked me to pass that info along to the neighbors. I'm glad I can relatively stay out of it. Only down side there, if the owner wants to come out himself, he'll see the kind of hell my dog has played on the backyard. :-/



And no, he does not jump on the fence. That sag was from the last wind storm where the owner wouldn't even respond to my email about the wind damage.

I can walk a mile and pass several hundred 1+ acre lots that don't have fences around the parcels.

In fact, I can walk out my back yard and find a parcel that does not yet have a fence around it, although that is going to change within the next couple of weeks due to kids and dogs running amuk.

My initial plan was to build my fence about 8 to 10 feet inside my property line so that A) it is completely MY fence and not shared between my neighbor and B) so that I have plenty of access to maintain the grass on the other side (our POA restrictions only allow for wrought iron, 3 rail horse fence or 6' privacy fence). However, talking with one of my neighbors, she is interested in building a fence to match mine in her back yard as well. I plan on discussing this with whomever wins the bid for mine and possibly moving that side to the PL so that we have a shared fence, thus decreasing the cost to both of us.

However, we will agree to everything prior to any construction.

Norman - if I could get some free time, I'd like to update my blog on my website (sbmoonlaw.com). Maybe I could write it up on civil trespass.

And, I really hope you (or anyone here) didn't think I was trying to be a knowitall. Because, trust me, I learn something new everyday!
