Eh, I had a hospital send the results of an eye test to a government agency after I specifically told them I didn't want them to inform anyone until I knew the results. Nothing happened to the doctor, the technician, or the administrators involved. In fact, the hospital tried to charge me a fee for them figuring out who ****ed up.

No.. not at all. A business is not subject to HIPAA because they are not a "covered entity" that provides healthcare services.

There is also a provision in HIPAA for pandemic/public health. Furthermore, the OCR has made huge exceptions during the pandemic to basically say "anything reasonable will have a pass."

For the record, I spend a whole lot of time reading HHS/HIPAA security and privacy rules for a living.

Caveat: A business associate that signs a BAA is different. They are subject to HIPAA, but they are also not usually a resturant or airline.

In other words, not a medical provider or a facilitator of medical care then HIPAA generally doesn't apply.

A business can ask for proof of vaccination, you're free to decline to respond. An employer can make vaccination a condition of employment, you don't have to disclose your vaccination status, but in most states they can fire you for not providing it.

I think they should be allowed to, I just don't think they should exercise that right.

HIPAA protects citizens (privacy of medical records) from GOVERNMENT violations of privacy.

If the US, or any state/local gov entities attempt this, then it is a HIPAA violation.

For now. It depends how the Georgia senate runoffs go. Also, unauthorized disclosures of confidential health information create civil liabilities for private parties too.

If the Ga. senate races are lost, the left doesn't have to (and won't) pretend to care about any personal/individual rights any longer, including privacy.
