This doesn't qualify as "prohibited outside income" under Fran's contract, does it? It would be true justice if he lost out on $8M + for a few $1,200 checks due to breach of contract...

I think this is shocking. I wish some of the lawyers on here would check to see if it is illegal, i.e., using your position as a state employee for private gain. And it doesn't matter a damn what you say you use the money for. Not to mention the potential for gambling abuse. Don't coaches have to attend the anti-gambling seminars that players do?

Sure would like to know the names of the "Confidential 12."

Two observations:

1. Now we know what Mike and Brent were arguing about.
2. Fran's odds of lasting the season just went down.

well if the media found out about it, someone has obviously breached their confidentiality agreement.

I don't really think the fact he was sending out these reports is a big story. What I do find to be a big story, is the fact that these reports were obviously sent to a small select group of guys who were probably Fran's biggest supporters, and it looks like even this group has lost faith if they are running to the media with this stuff now.

According to this story, BB didn't know about it. Hints of degradation of institutional control. The really weird part of it is that he could have pulled in a lot more $$s to support his website, give to the little sisters of the poor or whatever, if it had simply been a public subscription that anyone could buy. The whole thing is really, really dumb.

If you are in the spotlight (and paid big bucks to take the heat), you should never do anything you don't want to read about on the front page of the paper.

That's the most troubling part of the whole thing. Firstly, that BB was in the dark about it, and, secondly, that he was OK with doing something as long as he wasn't caught. That's a terrible precedent and message all in one.

I'm no expert on gambling law, but I wouldn't be surprised if gaining this advantage was verging on illegal. I could certainly be wrong, though

fran was. the article itself states that he was using it to fund coachfran.com. i guess he kicked his buddy back a few hunskey to put the newsletter together.

i know, which is exactly why I don't see how that part (using your position as a state employee to make a profit) could be illegal.

Now, what would be interesting is whether the injury information he was disclosing violated HIPAA. I know HIPAA makes exceptions for the NCAA and I'm pretty sure all athletes are required to sign some sort of authorization forms, but not sure whether such a form would cover the coach's use of the injury info for the purposes described in the article. Would be interested to see what that compliance officer that posts on the recruiting board says about that.

Yikes. I don't see a problem with it, until someone decides to screw the whole thing and turn over a copy to the media. I don't think it's too different from the six insurance salesmen that would meet every Tuesday and Thursday for lunch at the restaurant I worked at and talk shop (basically exchange ideas and information). It's all fine and dandy until someone in power finds out, then it's... Yikes.

HIPAA just says you can't disclose health records. he is allowed to make more general comments about whether the player will be starting or not.

Maybe it's because it is 1:30 in the morning, and I'm not thinking straight, but I don't feel this is much of a story at all. I have to agree with unmade bed here though, at least one "insider" has become a turncoat and I think that is the real story.

you're right, i'm sure these type of things happen a lot. i just don't like the idea of this smug ******* putting together a list of injury reports to make an extra 150K or so. if these boosters are so loyal and trustworthy...then why charge anything at all?
