This is ridiculous, the dudes alcohol wasn't even that high. Tabc witch hunts are getting over the top

Probably focusing in making examples in that area due to the recent rash of retards driving the wrong way on the feeder and killing poeple.

And both drivers were German IIRC, there is a distinct cultural thing amongst Germans where driving drunk is normal.

I'm not saying it's not tragic that innnocent people were killed but the ridiculous harassment is unnecessary.

I think the Wrong-Way Retards probably had death wishes anyway. I've never been drunk enough to make a u-turn onto an exit ramp.

0.13? Every bartender around could be busted for this and bars would go out of business if they routinely busted bartenders for this.

They didn't arrest her because they tested him and he was .13. He was "stumbling around and yelling racial epithets", so she should have had better judgement and not served him anymore.

A bartender is not supposed to serve someone who seems really drunk, and that judgement isn't based on their BAC (how would a bartender ever know this?), it's based on the person's actions and how coherent they are.

Unfortunately, 62strat makes a good point, if I can remember my TABC certification classes from 15 years ago. Bartender's required judgment is based on behavior and physical indicators (i.e. glassy eyes, etc) not BAC.

.13 does not make you stumble around and yell racial epitaths unless that is your normal persona. Something tells me he was not that bad it was exagerated by TABC.

I like how the Chron posted the mugshot. It's a white woman so there was no need to be ambiguous about race.

The standard is somewhat subjective. No way to know if you didn't witness it.

I got cut off once after like two drinks, but that was mainly because some crazy chick with an axe to grind on me showed up and complained to the bartenders about my "inebriated" behavior, by which she probably meant I didn't seem happy to see her again.

people get kicked out of bars all the time for their normal persona.

No one said .13 BAC will make someone do these things, but this person was doing these things, end of story. He should have been cut off.

I spent 4 of my 5 years in college working in bars around BCS and yes, they teach you to recognize these things.

However, there is zero legal test or standard for public intoxication. If the officer thinks you're drunk then you're drunk. So the argument this guy could just be an ******** normally holds a lot of water.

TABC definitely started cracking down after the wrong-way drivers.

I know a guy who left Wolfies on I-45 drunk a week or two after the wrong-way incidents. I don't know how drunk he was since I wasn't there, but a cop in the parking lot asked him if he was planning to drive. He said yes and was immediately arrested for PI. If he had someone else to drive him, they would've let him go.
