I have worked downtown for a year now. Every morning I pull in and pay the electronic parking meter the $7 it costs to park for the day. Today was no different. Parked...PAID...and came out after work to a bright orange boot on my tire. To say I was furious is an understatement. I peered in my car to be sure I had remembered to place my ticket face up on the dashboard. Sure enough, there it was. Face up and timestamped for 8:28AM. I had not left at any time during the day, yet there was a boot on my tire. So, in my anger I called the booting company only to be sent to voicemail after being on hold for 20 minutes. Not knowing what to do, I called my father who sent me this article about the very same booting company that I was dealing with.

Getting even more angry, I took photos of my car and called the police. I finally spoke to the booting company's dispatcher, who told me that the person who responded to the call would have a video of why my car was booted. The employee showed up, now nearly an hour after I arrived at my car and surprise surprise, there was no video when I asked to see it. He was very persistent that I must have left the lot because he was the one who patrols and my back tire had not been "chalked." I kindly informed him that I had called the police, had already taken photographs of my car and planned to take him to small claims court if I was made to pay the $100 fine. His attitude changed 100%. Suddenly, he informed me that he did have the authority to take off boots when he felt the individual was truly being honest about the situation. He said, you know "mistakes do happen." I certainly agree that they do, just thought it was funny that this only became a "mistake" after I told him my action plan about the situation.

Anyone else experience anything like this parking downtown?

i don't know why the city lets these people (and tow trucks for that matter) run around like they're above the law.

I get so sick of seeing tow trucks up and down McGowen every weekend. They set up in the middle of the streets so you can't pass and then eyeball you when you tell them to move.

****ing scum is all they are.

I would take them to small claims court anyway for loss of your time and cell phone minutes.

In small claims, you can only go after actual damages, so you have to put a value on your minutes, but your time does not have an intrinsic value unless you lost wages over it. Even still, you could sue them for $1.00 in cell phone time out of principle. Just having a judgment against them is bad for them.

Ags2006, did you get your money back? I have the e-mail address of the person who runs the local company.

The AGs of California and Washington have deemed booting illegal.

I had an issue in June. I did pay, but put it in the incorrect slot. But, alas, there was no proof to Bootman, inc, D/B/A Premier Parking Enforcement, that I paid. I wrote a certified letter to Premier Parking Enforcement and the parking lot owner, also sending the note via e-mail.

After a couple e-mail exchanges, and right before I was going to suggest that THEY file a police report on me, I got a call that my 'fine' was being refunded.

My suggestion to you, Ags2006, is to write the BBB, the 5 At-Large City Councilmen, the District I rep -- James Rodriguez, liliana.rambo@cityofhouston.net, Rodney Ellis & Garnet Coleman the State Senator and Rep for Downtown, and Bill White. Plus anyone else you want. Tell them of your experience and that regulations are needed for the industry. Heck, even towing has a court for tow appeals.

Plus, though they probably pay a franchise tax, the towing fee has no sales tax associated. I'm not sure whether parking is taxed. Thus, their is more than likely very little auditing going on.

There have been enough news reports --- but it always happens to "the other guy".

speaking of tow truck drivers, why are they allowed to haul ass up and down the highways? i'm literally waiting for one of these *******s to crush a family of 4 and only THEN will people take notice...

Tow truck companies are the scum of the earth. These people have little redeemable value in this world. I'm honestly shocked more of these guys haven't been shot. I'm not advocating that, but I can see them tying up with someone who doesn't give a damn.
