Yes, and if he shot him he'd be in jail for murder. A bit much imo.

He's a cop, he wasn't going to shoot him. Per the law in Texas at least you have the right to defend your property. Including personal items, pets, House etc

**** criminals, they all deserve to rot

Not according to:

quote:

9.41. PROTECTION OF ONE'S OWN PROPERTY. (a) A person in
lawful possession of land or tangible, movable property is
justified in using force against another when and to the degree the
actor reasonably believes the force is immediately necessary to
prevent or terminate the other's trespass on the land or unlawful
interference with the property.
(b) A person unlawfully dispossessed of land or tangible,
movable property by another is justified in using force against the
other when and to the degree the actor reasonably believes the force
is immediately necessary to reenter the land or recover the
property if the actor uses the force immediately or in fresh pursuit
after the dispossession and:
(1) the actor reasonably believes the other had no
claim of right when he dispossessed the actor; or
(2) the other accomplished the dispossession by using
force, threat, or fraud against the actor.

9.42. DEADLY FORCE TO PROTECT PROPERTY. A person is
justified in using deadly force against another to protect land or
tangible, movable property:
(1) if he would be justified in using force against the
other under Section 9.41; and
(2) when and to the degree he reasonably believes the
deadly force is immediately necessary:
(A) to prevent the other's imminent commission of
arson, burglary, robbery, aggravated robbery, theft during the
nighttime, or criminal mischief during the nighttime; or
(B) to prevent the other who is fleeing
immediately after committing burglary, robbery, aggravated
robbery, or theft during the nighttime from escaping with the
property; and
(3) he reasonably believes that:
(A) the land or property cannot be protected or
recovered by any other means; or
(B) the use of force other than deadly force to
protect or recover the land or property would expose the actor or
another to a substantial risk of death or serious bodily injury.

I stand corrected. Please shoot all thieves in the back. I will refrain from having an opinion in the future.

He didn't shoot him. He defended his property with non-lethal force. It may have become lethal force to protect himself if the guy attacked, which would have been justified.

I hate thieves. I've had my clubs stolen and it sucks. That was a ridiculous thing to do.

Once you pull that gun you put yourself in a terrible position. Never pull it unless you intend to use it. Tackling the guy and kicking his ass sounds a lot better of an option, but I'm also 32 with a family. Old guys just don't give a ****.

Hasn't the thief heard of Ebay? It's the world's leading seller of clubs that fell off of the truck.

You are confused. I was directly responding to your statement that:

quote:

You don't have the right to use lethal force to defend your personal possessions. Only to save your life.

I am not discussing this situation in particular, only stating that you can in fact use deadly force to protect your personal possessions as outlined in 9.41 and 9.42.

Don't really care about what the law says it's just very dumb to pursue a criminal over golf clubs. If that guy has his own gun you are setting up a pretty major situation.

It's like the people that get car jacked and shot because they don't want to give up their car. Let it go my man. Not worth the risk.

I had my car stolen with my clubs in it. I got the car back and not the clubs. I would have rather had it the other way around.
