If it is decided to go back with a counter petition, would that be the same format to use as the original petition, just reversing the names?

Yes but also change all references to petition to counter-petition and you need to include a cerificate of service at the end. Copy must be sent cmrrr to opposing party and/or attorney.

So is there a place to get this form where I can easily change it? Or is it acceptable to cross out original and write counter?

Got kids?

Supreme Court of Texas has forms online for pro se divorce

Otherwise retype, OCR, or find a greensheet lawyer to file for you

Unless you plan on alleging new grounds for divorce, you should just file an Answer with a General Denial. If you are wanting to counter-petition with new grounds, you are probably going to expand the nature of the proceeding to a more "contested" matter and you should get an attorney for that.

Just my 2 cents.

Wrong.

You file a counter petition in case the wife withdraws her petition and you want to continue with divorce. Gives you the option to proceed without having to start all over and re-file, pay a filing fee, and getting her served.

But there is no counter petition form.

FYI this isn't for me.

She filed and he agreed with the petition before she filed. 60 have passed and she won't go get a court date, as she knows the gravy train ends when that happens.

Our advice at this point is go get the court date and bring the original with you to court.

I am an attorney but I had the wherewithal not to get involved in family law work. Go find a family law/divorce lawyer because the last time I dealt with that trash was on the bar exam and that was a loooooooooong time ago.

Based on how pissed one or both parties is, there is no such thing as a basic divorce question.
