Somewhat difficult to arrest the guy when you're afraid for your life that the perp may be pulling a gun.

At the end of the day the guy was an idiot for running from the cops, injuring innocent bystanders, jumping out of the car and then returning to the car for something. Every move he made was wrong.

Not to mention that he called in to 911 that he had a baby in the car he would injure if they got too close
